I acknowledge, understand, and agree that my participation in any programs made available through Televeda’s platform including without limitation participation in any fitness class, peer support or community engagement group, or training (collectively, the “Televeda Services”), is at my own risk and I am solely responsible for and expressly accept and assume all risk inherent in participating in said programs. I have considered the risks inherent to participating in the Televeda Services and I appreciate that there is a risk of serious injury, including without limitation physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability, death, or economic injury or emotional loss. I understand that these injuries may arise from the negligence or other misconduct of others or myself. I understand and acknowledge that I must determine my own ability to participate in any program (including fitness) and do so at my own risk, as noted above and herein. I realize that participation in Televeda Services may involve physical activity which may be strenuous on both my body and mind. I represent that I have conferred with appropriate and trusted healthcare and other professionals to determine that I am capable of participating in the Televeda Services. In the event that I require medical care or treatment, I authorize Televeda to call 911. I understand that Televeda may use artificial intelligence to enhance the quality of services I receive and to improve its operational practices, and hereby consent to the same.

I HEREBY ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS "WAIVER AND RELEASE OF LIABILITY & ASSUMPTION OF RISK" AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I EXPRESSLY AGREE TO RELEASE AND DISCHARGE, WAIVE, AND COVENANT NOT TO SUE TELEVEDA SYSTEMS, INC., OR ANY OF ITS AFFILIATED INDIVIDUALS OR ENTITIES, including, directors, officers, employees, agents, successors and assigns (hereinafter collectively referred to as “Released Parties”) from all liability to me, my personal representatives, assigns, heirs and next of kin for any loss or damage, and any claims or demands on account of injury to me or any other person or property or resulting in my death or the death of another, whether caused by the negligence, OR GROSS NEGLIGENGE In the event A COURT DECLINES TO impose a standard of mere negligence, of the Released Parties or otherwise engaged in any activity, training or program of or made available through the Released Parties.

I consent to the use of any image taken of me while using the Televeda Services. I have read and voluntarily sign this Waiver and Release of Liability & Assumption of Risk. I agree that any action or proceeding initiated relative to this Waiver of Liability & Assumption of Risk or any claim I (or my heirs, successors or assigns) may have against any of the Released Parties shall be brought solely in the state or federal courts within Phoenix, Arizona, and I hereby irrevocably submit to the exclusive jurisdiction of these courts. I understand that this Waiver and Release of Liability & Assumption of Risk shall be deemed to have been executed within the State of Arizona, and my rights and obligations hereto shall be construed and enforced in accordance with, and governed by, the laws of the State of Arizona.

I UNDERSTAND THAT THIS WAIVER AND RELEASE OF LIABILITY & ASSUMPTION OF RISK SHALL REMAIN IN EFFECT FOR THE DURATION OF MY PARTICIPATION IN ALL ACTIVITIES WITH TELEVEDA, DURING THIS INITIAL AND ALL SUBSEQUENT EVENTS OF PARTICIPATION.
